The telecommunications industry is heavily regulated with wide variation
in terms and conditions among services in different jurisdictions. For
local and long distance telecommunications service, CloseCall America
has filed publicly available tariffs which outline State mandated terms
and conditions governing service provision. Please contact customer
service for any tariff inquires. Regulatory law will govern all
customer relationships for products and services where mandated by
proper authorities. For all customer relationships not expressly
governed by regulatory law the following terms and conditions will
prevail:
Consumers sign up for CloseCall America services by telephone, online at
www.closecall.com or by mail order. For the purpose of fraud
prevention and order authentication CloseCall may request a Social
Security or driver's license number. CloseCall America bills for
requested services reguardless of actual usage. In certain cases trial
use periods may be established where customers are not charged for
the use of a product over a predetermined timeframe. In the case that a
customer is billed beyond the scope of services ordered or different
than the understood rates, then a rerate may be requested. If it is
determined that a customer was billed incorrectly, then a bill credit or
debit will be applied to consumers CloseCall America account. In
accordance with regulatory guidelines, CloseCall America will not issue
credit for a charge that has not been submitted for dispute within
ninety (90) days of its billing. If a credit exists on customer's
account and the customer no longer has active service with CloseCall
America, then a refund will either be issued to customer via check or to
credit card depending on the method in which the customer paid for their
services.
Suspending and Cancelling Services
a. Your Cancellation of the Services. If you use more than one Service, you may change or cancel individual Services by calling the CloseCall America customer service number on your CloseCall America bill, subject to the applicable terms and conditions set forth herein.
This Agreement remains in effect for any Services that you continue to be enrolled in, use, or pay for. If you want to cancel all of the Services, call the customer service number on your CloseCall America bill for further instructions. CloseCall America assesses fees on regulated telecommunications services consistent with the requirements of regulatory bodies exercising jurisdiction over a given service. Unless otherwise stated in a filed tariff or disallowed by regulatory law, CloseCall America charges $22.00 to business and residential customers for switching service to another carrier. Unless otherwise stated in a filed tariff or disallowed by regulatory law, CloseCall America charges a $4.90 to residential customers and $27.90 to business customers for fully disconnecting a local line. If you either voluntarily cancel your account with CloseCall America or if the Company cancels your service for any reason, the Company will have no obligation to assist you in any respect in switching from the Company to another carrier.
Please note that if CloseCall America is designated as your primary carrier, you must contact your former local exchange and long distance companies to ensure that your former service with those carriers is cancelled. You will be responsible for payments of all charges incurred with your prior carriers prior to the activation of your account with CloseCall America.
As a condition of offering discounted rates on wireless equipment CloseCall America asks that its customer sign either a one (1) year or two (2) year contract. Wireless service customers who cancel or switch service to another before the expiration of their wireless service contract will be subject to an early termination fee of $175.
b. Fraudulent Use. You may not use the Services for any unlawful, abusive, or fraudulent purpose, including, for example, using the Services in a way that (1) interferes with our ability to provide Services to you or other customers; or (2) avoids your obligation to pay for the Services. If CloseCall America has reason to believe that you or someone else is abusing the Services, using the Services in violation of these terms and conditions or using them fraudulently or unlawfully, we may immediately suspend, restrict, or cancel the Services without advance notice.
c. Failure to Pay. Upon advance notice as governed by applicable law and regulation, we may suspend, restrict, or cancel the Services and this Agreement, if you do not make payments for current or prior bills by the required due date, including payments for late fees or any other required additional charges.
d. Other. CloseCall America may from time to time discontinue certain services in accordance with applicable laws and regulations.
e. Outstanding Charges. If Services are suspended, restricted, or cancelled, any usage charges will accrue through the date that CloseCall America fully processes the suspension, restriction or cancellation. Monthly charges will accrue to the end of the monthly service period. You must pay all outstanding charges for these Services, including payment of any bills that remain due after the date of cancellation. You must reimburse us for any reasonable costs we incur, including attorneys' fees, to collect charges owed to us. If you want us to renew the Services, we may require that you pay a deposit. |
